The Punjab Ombudsman has ruled the allotment of official accommodation to contractual employee is in violation to the official policy and tantamount to maladministration.
According to the details, Muhammad Zafar Khan - Stenographer in the Office of District Police Office Toba Tek Singh complained to the Mohtasib Secretariat that he was allotted quarter No 13 (5/10) Officers Colony No 1 Toba Tek Singh. The complainant pointed out the same quarter was situated on second floor and his father, who is 90 years old, could not move about due to fracture and was in the wheel chair.
He requested the DCO Toba Tek Singh for allotment of an official quarter on the ground floor. The DCO allotted him quarter No 15/14 on the ground floor, which was to be vacated on 31-12-2004. District Officer (Revenue) Toba Tek Singh, however, did not issue the allotment order in respect of quarter No 15/14.
Meanwhile, DCO Toba Tek Singh was transferred and District Officer (Revenue) Toba Tek Singh allotted the same quarter in the name of Bushra Rafique, who is a contractual employee and is the daughter of retired Superintendent of his office.
The complainant requested the Mohtasib Secretariat that illegal allotment of the quarter No 15/14, in the name of a contractual employee, be got cancelled and the same be allotted in his name.
After hearing the case in detail, the Ombudsman observed the quarter No 15/14 was approved for allotment in the complainant's name. However, orders were not issued and, in the meantime, it was allotted to Bushra Rafique D/o ex-Superintendent of District Officer (Revenue) Toba Tek Singh. Bushra Rafique's terms and conditions of appointment did not provide for allotment of government accommodation.
Her father was summoned and heard who took the plea that the allotment in favour of his daughter had been made under the policy governing allotment of government residential accommodation at district level. It was however, found that the facility of allotment of government accommodation to real son/daughter of a retiring government servant is restricted to employee up to BS-13 and the Superintendent, being in higher scale, could not avail of this concession.
Therefore, allotment in favour of Bushra Rafique under the Parents Concession Scheme, being in violation of the policy, amounted to maladministration.
It was directed the allotment of the quarter in question be cancelled from the name of Bushra Rafique and it be allotted in the name of the complainant Muhammad Zafar Khan.
In his compliance report, DCO Toba Tek Singh has now informed Mohtasib Secretariat the allotment of plot in question has been cancelled from the name of Bushra Rafique and the residence had been allotted to the complainant Muhammad Zafar Khan - Stenographer, on usual terms and conditions with immediate effect.
