The Ministry of Law and Justice has allowed the Central Board of Revenue (CBR) to give 50 percent advance payment of fee to its lawyers at the level of tribunals, high courts and Supreme Court of Pakistan.
In this regard, the CBR has issued instructions to all the regional commissioners of income tax (RCIT), collectors of customs and sales tax on Monday.
Official sources told Business Recorder that the CBR had approached the law division for the restoration of 50 percent advance fee to the legal advisors and departmental advocates. The demand was made to give an incentive to the lawyers for properly pursuing the pending cases at various judicial fora.
According to the ministry of law directive, "the ministry has agreed to the proposal of revival of the practice of advance payment of 50 percent of the fee and miscellaneous expenses to the counsels/legal advisors engaged by the CBR".
Officials said that the regional departments should also pay expenses to the departmental representatives in advance. An amount of Rs 1,000 would be paid as expenses in the first case to the lawyer of the Supreme Court. The department will also pay Rs 300 per case on the same issue, if several cases are involved. Similarly, Rs 500 would be paid in each case at the level of high court and tribunals.
In case the lawyer is coming from other city, economy class air ticket and daily expenses equivalent to a BS-20 officer should be paid to the lawyer on submission of hotel receipt.
The CBR has allowed the collectors, commissioners to pay expenses of air ticket and hotel expenses in advance as well.
