The Lahore High Court (LHC), while disposing of a petition filed by one Dr Waqar Anjum, has observed that it is a settled law that after taking cognisance of the case by a trial court, the question regarding being guilty or not of an accused is to be decided by the court on the basis of evidence given to it before and not on the basis of police opinion.
The court observed that opinion of police in such matter is not admissible. The court further observed it is sanguine that the court in present case shall be cognisant of settled legal position.
The petitioner had assailed orders of a board headed by superintendent of police, Lahore and its findings to change the investigation.
