On the directive of the Wafaqi Mohtasib, the Works Division has de-hired and handed over vacant possession of a house in Islamabad from a senior serving government officer to its rightful owner.
He took the action on a complaint filed by Khalida Shahzada Khan, a resident of Islamabad, in which she stated that her husband's house in Islamabad was hired by the Estate Office from July 11, 2000 to July 10, 2003 at a monthly rent of Rs 8,567.
She stated that 50 days before the expiry of lease, she applied to the Estate Office on May 19, 2003 for dehiring and vacation of the house.
The Works Division dehired the house on September 16, 2003 and directed the Estate Office for its early vacation and handing over possession to the owner which, however, was not complied.
The Works Division issued several reminders to the Estate Office for early vacation but never got its orders implemented. Finding no relief forthcoming from the Agency and its functionaries, she approached the Wafaqi Mohtasib and her complaint was duly registered on October 25, 2004.
After due process, the Wafaqi Mohtasib directed the Estate Office to take legal action against the occupant, get the house vacated and hand over its possession to the owner.
The Works Division was further directed to take steps to allot alternate accommodation to the occupant/allottee, if allowed under the rules or alternatively hire a house of his entitlement when pointed out by him without linking with the vacation of the house.
The Works Division was asked to show cause within a period of 30 days as to why the rent claimed by the complainant on market rates should not be awarded to the owner by way of compensation and submit implementation report maximum within 45 days or reasons for not doing the same be intimated.
In the light of Wafaqi Mohtasib directions, the Works Division has intimated dehiring and handing over the possession of the vacant house to the complainant after it was issued a final notice for Defiance of Recommendations of the Ombudsman.
