The NWFP Assembly on Friday passed amendment in North-West Frontier Province Prohibition of Kite Flying Activities Bill, 2006 amid hue and cry of the members of PPP-Parliamentarian and ANP over the inclusion of six kilometre radius surrounding the airport/airbase in the provincial metropolis.
The Prohibition of Kite Flying Activities Bill, 2006 was passed by the provincial legislature on April 4, 2006 and was sent to the governor for his assent, however he returned it with the proposed amendment to the House suggesting amendment in Section 2 (d) relating to the definition of place and Section 4 (2) that under no circumstances kite flying shall be allowed in the vicinity of airports, airbases as defined in the Section 2.
Similarly, Section 6 relating to that a police officer not below the rank of assistant sub-inspector upon information or from his personal knowledge, as he thinks necessary may arrest, without warrant, any person committing or suspected to have committed under section 5 enter and search such place at any time with such assistance as he may require and using force as may be necessary and seize and take possession of any article reasonably suspected to have been used or intended to be used for the purpose of committing an offence under this act.
The bill on behalf of chief minister was presented in the House by provincial Minister for Law and Parliamentary Affairs, Malik Zafar Azam for reconsideration. However, senior parliamentarian and parliamentary leader of PPP in the provincial assembly, Abdul Akbar Khan opposed it on the ground that after the passage of the bill it goes to governor for assent, who sign it in a period of 30 days. He said it is required in the case of money bill and in case of other bills it directly becomes law. However he said in the case of the Prohibition of Kite Flying Activities Bill, the governor has exhausted this available option.
"The bill, he said, just after passage from the assembly becomes a law either assent or decent of the governor," Abdul Akbar Khan contended adding that at the time of sending of ordinance, the governor had not proposed any amendment, due to which he said he had lost option. He said that the sending of the bill for reconsideration and amendments in section 2-D would make the bill defective.
Bashir Ahmad Bilour of ANP said that bill passed by the House last month allows kite flying for a period of 15 days, which also include the area mentioned in the amended bill. He suggested that the bill should add with a word excluding the area of 6-kilometre radius of the airports and airbases in the province.
Replying questions raised by the opposition members, Minister for Law and Parliamentary Affairs, Malik Zafar Azam defended the amendments proposed by the governor in the bill and said that the bill has been returned for the reconsideration for bringing more improvements in it.
Earlier, Speaker Bakht Jehan Khan referred the questions regarding irregularities in recruitment in RWSSP project, utilisation of local government funds in the union councils of PF-26 Mardan to the standing committees concerned and converted a question regarding the utilisation of funds collected under head of sugar cess for detail debate in the House.
