Governor Sindh, Dr Ishrat-ul-Ibad has promulgated the Sindh prohibition on manufacture, sale and use of polythene bags ordinance, 2006 with immediate effect, which shall be deemed to have taken effect from May 01, 2006.
Governor Sindh, in exercise of the powers conferred by clause (1) of Article 128 of the Constitution of the Islamic Republic of Pakistan, has promulgated the ordinance to prohibit, manufacture, sale and use of black polythene bags including bags below 30 micron thickness.
The ordinance restricts that no person shall manufacture, sell or use black polythene bags including the polythene bags below 30-micron thickness. Offering any kind of eatable and non-eatable goods in such bags has also been restricted.
The ordinance adds that any person contravening the provisions could be sentenced up to three-month imprisonment or a fine up to Rs 50,000 or both. It is pertinent to mention here that if any person convicted for an offence punishable under the section of this ordinance is again convicted could be sentenced up to six-month imprisonment while the amount of fine could be up to Rs 100,000.
"Notwithstanding anything contained in the Code of criminal Procedures, 1898, an offence punishable under this Ordinance shall be bail-able and tried under the provisions of the said Code, by a judicial magistrate specially empowered in this behalf under section 24 of the Pakistan Environmental Protection Act, 1997," the Ordinance adds.
No court shall take cognisance of an offence under this Ordinance except upon a complaint in writing by the Director General, Provincial Environmental Agency or any other authorised officer of the agency.-PR
