The Supreme Court has issued stern warning to Tanvir Ahmad, Advocate-on-Record with a direction to perform his duties and obligations properly in line with the dignity and decorum of the court.
The warning, conveyed by the SC Registrar, said that Criminal petition (Faiz Muhammad vs Bashir Ahmad, etc) was fixed before a Bench of the Supreme Court comprising Justice Rana Bhagwandas, Justice Tassaduq Hussain Jillani, and Justice Raja Fayyaz Ahmed on March 27, 2006 and was called up at its turn in the early morning, but Advocate-on-Record Tanvir Ahmad instead of appearing before the court mysteriously disappeared with the result that the case was kept aside in view of the gravity of the offence and the judgement passed by the high court.
The warning said: "When the case was called again Advocate-on-Record Tanvir Ahmad stated at the bar that Inayat Khan Niazi, ASC, has lost contact with him, therefore, he (Tanvir Ahmad) would like dismissal of the petition for lack of instruction."
The court seized the matter observed that it cannot shut its eyes at this attitude as under the Supreme Court Rules 1980, it is the Advocate-on-Record, who is responsible to the court for presentation of a petition for further proceedings.
The court also observed that it is the Advocate-on-Record, who engaged the Advocate of Supreme Court, and not vice versa, as pleaded by Tanvir Ahmad, and directed to issue show-cause notice to him, as to why proceedings for cancellation of his enrolment be not taken against him.
"After going through his reply to the show-cause notice the court administered him a stern warning with direction to perform his duties and obligations property and keeping in line with the dignity and decorum of the court.
