Sindh High Court on Monday issued pre-admission notices to Privatisation Commission, Ministry of Water and Power, new management of Karachi Electric Supply Corporation, and others for July 25, 2006, on petition against KESC privatisation.
Petitioners Moulvi Iqbal Haider and Imran Shahzad submitted in the petition that privatisation of KESC "is against national interest" and article 153, 154 of the Constitution.
Their counsel, Sohail Hameed, apprised the court that in a recent case against privatisation of Pakistan Steel Mill the Supreme Court held the process of privatisation bypassing the approval of Council of Common Interests as unlawful and void.
He said petitioners being pro bono publico are justified to take up such matter before the court. He asked the court to declare privatisation of KESC void ab initio, and direct federal government to refer the matter of privatisation of KESC to Council of Common Interests and thereby to act according to article 153,154 of the Constitution.
SHC division bench comprising Justice Anwar Zaheer Jamali and Justice Mohammad Afzal Soomro, after preliminary hearing of the petition, issued pre-admission notices to respondents for July 25, 2006.
