Poland's telecoms authority must drop plans to regulate retail broadband access as they may harm competition and hinder the development of broadband infrastructure, the European Commission said on Monday.
"So far, retail broadband access services have not been regulated in any other member state," Information Society Commissioner Viviane Reding said in a statement. "Regulation can only be imposed on the basis of correct market analysis."
The EU executive said a market analysis carried out by UKE, the Polish regulator, was incorrect and that imposing regulation could harm the country's top telecoms group TPSA.
Regulation "may hinder TPSA in its ability to compete for the provision of such services and may discourage TPSA, as well as other operators, from investing in the development of broadband infrastructure", the Commission said.
