Former Chief Justice of Pakistan Syed Sajjad Ali Shah has said that Justice Iftikhar could file petition in the Supreme Court for the removal of his grievances. Talking to a private TV channel he said the Chief Justice could seek relief from the apex court.
He said the Chief Justice has a point as to how an acting Chief Justice is appointed in the presence of the Chief Justice in the country and how he can be sent on forced leave without any reason.
"His grievance is right and his stance is worth hearing," Sajjad Ali Shah observed. Government's counsel Malik Abdul Qayyum speaking at the same programme said the Supreme Court could not stop the proceedings by the Supreme Judicial Council. He said the Supreme Judicial Council is a part of the Supreme Court in the light of the Constitution.
He said that the Supreme Judicial Council consists of three senior judges of the apex court and two senior judges of the High Courts. The Supreme Court has more powers than the Supreme Judicial Council and the Supreme Court can even interpret the Constitution. "It is the final decision-making body". He said that Aitzaz Ahsan has filed a petition against the reference but whether or not it was right and according to the law and the Constitution, would be decided by the apex court.
