Former Chief Justice of Pakistan Saeed-uz-Zaman Siddiqui has said that the affidavit submitted by Chief Justice Iftikhar Muhammad Chaudhry has become public as it is presented in an open court. In an interview with the BBC he said that the affidavit will apply to the Army Chief and officials, saying they can file a reply.
A rejoinder can also be filed, he added. The former Chief Justice said the Supreme Court would decide what the status of the claims in the affidavit is and whether or not they are reliable. "If this affidavit had been filed in the Supreme Judicial Council it could not have been published, he said, adding, "It came in your hands because it has been filed in the open court proceedings."
The proceedings in the Supreme Court are open to public, he added. About the discussion on the affidavit he said no one could talk about it because the document is in the court, therefore, so long as the court does not give any verdict, no body can debate it. To another question Saeed-uz-Zaman Siddiqui said the federation will have to reply to the affidavit within three or four days. "Then in further four or five days a rejoinder can be filed by the Chief Justice."
