The Lahore High Court ordered again the Sheikhupura police to recover a seven-year-old French-Pakistani child Omar Malik from the custody of his father and produce him on September 18 as it failed time and again to recover him.
A bailiff deputed by the court informed that the husband of the petitioner and her child was not recovered from their Sheikhupura residence as they have shifted some other place. Peggy Collin had sought recovery and custody of her seven years old son, who was allegedly abducted by her dual national father Muhammad Ashfaq from France in violation of an agreement executed before a French court.
Petitioner Peggy Collin sought custody of her son contending that Muhammad Ashfaq, the father of the child had abducted him from France without her prior permission that was required under an agreement they both entered into before a French court.
She said her former husband and his family is currently living in District Sheikhupura where they have detained her son. She said a couple of days ago she received an anonymous call from Pakistan saying that her child is in the custody of his father. She claimed that she was a natural as well as legal guardian of her child and his custody should be handed over to her to take him back to France.
Peggy's counsel also told the court that Pakistan was not a signatory to Hague Convention but its spirit has been respected through numerous decisions of Supreme Court. Petitioner's counsel requested the court that despite handing over the custody of the minor to his mother criminal proceedings against the child's father might be initiated as well.
