Former Judge of Supreme Court Rana Baghwandas who refused to take oath under PCO, has said that he is still Judge of the Apex Court under the constitution and would go to the Court on Monday. He said the seven-member bench declared state of emergency as an act of extra-judicial according to the constitution.
In an interview to BBC Hindi Service, he said security forces cordoned off his residence, but he is determined to attend Supreme Court on Monday as he is the constitutional judge of Supreme Court. He said the seven-member bench decision was taken on November 2 and was conveyed to the media.
To a question, he said he went to his residence at 20:00 hours on Saturday night after issue the verdict on the constitutional application. He said government did not inform him about his removal as judge of the Supreme Court.
Regarding President's allegation on taking hundred of suo motu notices by the Supreme Court and crossing of limits, Raja Baghwan Das denied and said the judiciary works under the constitution. He, however, said that people would respond what is right or wrong. He said the verdicts of the judges speak itself. To another question, he said if he was stopped, he will return back because the judges do not protest on roads.
When asked whether it will be quite on his action, he said the time would respond it. He said the situation will change at any time and those taking extra-constitutional steps are responsible for this.
