President General Musharraf is a noble man, otherwise he would not have tolerated the 'retired' judges of the Supreme Court to write judgements which were null and void in law, said Attorney-General Malik Mohammad Qayyum here on Tuesday.
Talking to newsmen, informally, in the Supreme Court building, he said that the President had to take extra-constitutional measures very reluctantly, as the constitution did not provide remedy to the crisis created by the confrontation between the Judiciary and the Executive. He said that the constitutional forum-Supreme Judicial Council-created for hearing complaints against the judges was made non-functional, and the judges had started considering themselves above the law.
He said that welfare of the people is the supreme law of the land, and every action of a government is evaluated on this touchstone. Qayyum said that the Supreme Court would take up, and decide, the last petition against re-election of the President on Thursday.
He said the pre-Emergency 11-member supreme court bench, in a way, had created hurdles in the way of smooth and peaceful transition to full democracy, by blocking oath taking of General Pervez Musharraf as civilian President after his re-election. He said the President had reite4rated that he would put off his uniform before taking oath as President for another five-year term.
