A three-member bench of the Supreme Court headed by Chief Justice Abdul Hameed Dogar here on Monday accepted the request of the main petitioner for withdrawing his plea against establishment of the Federal High Court (FHC) in Islamabad.
Hassan Nawaz, the main petitioner, had sought a stay from the Lahore High Court, which was granted. Subsequently, Attorney General Malik Muhammad Qayyum had taken the plea against Lahore High Court's decision over which the bench of the Apex Court vacated the stay and granted leave to the federation on December 24, 2007.
It allowed the federation to proceed further regarding the establishment of the Islamabad High Court as the order passed by a three-member LHC bench was without jurisdiction.
Hassan Nawaz, the petitioner who had sought intervention of Lahore High Court against the establishment of Federal High Court, appeared before the Apex Court on Monday and said that he wanted to withdraw the case.
Attorney General, representing federation, said that when the case has been withdrawn, then there was no need for further proceedings. Justice Moosa K. Leghari and Justice Chaudhry Ejaz Yousaf were the other members of the bench.
