A division bench of High Court of Sindh (SHC) restrained City District Government Karachi (CDGK) from raising construction on disputed land of Yousuf Goth, Karachi West.
The bench comprising Justice Azizullah M. Memon and Justice Arshad Noor Khan was hearing a constitution petition filed by 55 residents of Yousuf Goth who maintained that their village was registered under Goth Abad Scheme (Kutchi Abadi Authority) and was an old village.
They maintained that CDGK was usurping their land to construct a bus terminal without any compensation or else. CDGK EDO Law Manzoor Ahmed in rebuttal submitted that the competent authority had notified that the land would be used only for "Public purposes" and a notification to this effect had been issued and gazetted. He sought 15 days time submitting that during this period all formalities would be completed for usage of the land for convenience to general public. The bench after this statement by counsel for CDGK granted one-month time to him directing him to submit all record to prove his statement before the court.
The bench observed that "petitioners would be dis-entitled to have the same (land) for their own use under the provisions of Kutchi Abadi Authority. The bench however also restrained CDGK from raising any construction at the dispute site. CDGK plans to built a mutli-purpose modern bus terminal for inter city buses plying between Sindh and Balochistan aimed at easing the traffic congestion in Karachi city.
