The Islamabad High Court here on Monday vacated a stay granted earlier against recovery of arrears from a defaulter construction company and allowed the Capital Development Authority (CDA) to take legal course to retrieve the dues. A Single Bench comprising Chief Justice Sardar Mohammad Aslam heard the plea.
Barrister Masroor Shah, who appeared as counsel for the CDA, apprised that a plot was sold out for the construction of Abu Dhabi Tower in Sector F-11. He said the construction company was not paying the Authority the arrears and had taken stay from he Lahore High Court, Rawlapindi Bench.
The company had constructed three basements and five stories which were against the laws framed by the CDA and it was a violation of certain construction rules, he added. He prayed to court that stay should be vacated as they had to disburse outstanding amount to various departments and the people.
Barrister Shah also brought to the notice of the court that the company's counsel routinely remained absent from the hearing. After hearing his plea, the Chief Justice vacated the stay and allowed CDA to recover the outstanding amount.
