A senior member of Lahore High Court Bar Association has moved to Lahore High Court against former President, Pervez Musharraf for his trial on charges of abrogation of the constitution. The petitioner Kamran Rasool Mirza prayed to the court that Musharraf should be charged with high treason under the Article six of the Constitution.
He said the respondent, Musharraf, violated the Article 244 of the Constitution on October 12, 1999 by removing the then premier, Nawaz Sharif. His subsequent acts of holding the constitution in abeyance and dissolving the assemblies, were also violations of the Constitution.
Further, the petitioner said that the former General again subverted the Constitution by suspending it on November 3, 2007 and declaring a state of emergency by issuing a Provisional Constitution Order. He was also guilty of removing judges and indulging in illegality by holding offices of the Chief of the Army Staff and the President of Pakistan simultaneously, the petitioner added.
