The Lahore High Court (LHC) while admitting a petition for regular hearing filed by Malik Tariq Ali, Mohd Khalil, Habib-ur-Rahman, Mazhar challenging their forced retirement before the age of superannuation, directed not to take any adverse action against the petitioners.
The petitioner contended that their termination was made in violation of PIA Rules, with malafide intention. The petitioners stated that PIA management cannot abuse their discretionary powers to send regular permanent employees on forced retirement. They said PIA at the same time hiring three retired Flight Engineers on contract to serve as Instructors. The petitioners prayed to declare the act as discretionary.
