A division bench of High Court of Sindh (SHC) comprising Justice Munib Ahmed Khan and Justice Dr Rana M. Shamim on Tuesday stayed the alleged illegal demolition of shops and dispossession of the two shop keepers by the owner lady and issued notices to respondents for a date to be fixed later by the office of the court.
The bench was hearing a constitution petition filed by shopkeepers Muhammad Haneef and Zainullah Beg against owner, respondents Mumtaz Begum. The petitioners maintained that they are tenants of respondents having shops on Nishter road, old items market and were served with notices to vacate the shops in the year 2000. The respondent later tried to get the shops demolished without permission from the KBCA and a case concerning the issue is pending before civil court since previous eight years.
The bench today after hearing the counsel for petitioners granted stay against demolition as well as dispossession. The bench also issued notice to the respondents including Chief Controller, KBCA and SHO Eidgah.
