The Supreme Court on Monday ordered judicial inquiry into a case of assault by the family members of a bureaucrat on two doctors of Federal Government Services Hospital (FGSH) A three-member bench of the apex court, comprising Chief Justice Abdul Hameed Dogar, Justice Ijaz-ul-Hassan and Ejaz Yousaf heard the suo motu case.
"We direct District & Sessions Judge, Islamabad to conduct judicial inquiry into the matter after affording full opportunity of hearing to all concerned and submit report to the Registrar of this Court within one week," said the judgement. Chief Justice Abdul Hameed Dogar on November 8 had taken suo motu notice on a press clipping appeared in different newspapers regarding the news of thrashing a female doctor of the FGSH (Polyclinic) Islamabad.
Suleman Ghani, Secretary Health, Asghar Raza Gardezi, Inspector General of Police (IG) and Kamran Lashari, Chief Commissioner Islamabad appeared before the court and submitted their reports pertaining to the matter.
Suleman Ghani, Secretary Health gave details of the incident that took place on November 1, at the FGSH. He said the ministry had taken the prompt action and lodged the complaint and initiated a departmental inquiry of the incident. He requested the court for conducting judicial inquiry due to seriousness of the matter.
Asghar Gardezi, IG, Islamabad, informed the court that Tariq Khakwani, Deputy Secretary National Assembly had submitted a written apology to the hospital administration on behalf of his family members. He said that initially on the complain of Dr Riffat, FIR was lodged under sections 353/186/147/149/342/427 PPC on November 3, at Aabpara Police Station, Islamabad. Later on, section 354, 337-A(i), 337-F(iii) PPC were added whereas section 427 PPC was deleted. He stated that in spite of best efforts, investigating officer could not arrest the accused.
In his report it is also mentioned that Mst Meeran Sharif moved an application addressed to the SHO Aabpara mentioning the cross version and requested for lodging of FIR which is not yet registered.
"If the offence was non-bailable why did the police fail to arrest culprits. Have you done something to address the issue," the Chief Justice observed. The IG told the court that the police was conducting raids to trace the culprits and will soon put them behind bars.
At a query from the CJ, Secretary Health informed the court that doctors have ended their protest demonstrations and were performing their duties. Kamran Lashari, Chief Commissioner, Islamabad stated that he also contacted Secretary Heath and Inspector General of Police Islamabad for taking action.
