The legal fraternity terming the Women Protection Act (WPA) 2006 as harmful and threat to social harmony held that it has encouraged women involvement in serious crimes.
Senior lawyers in the district and High courts, Multan, while talking to this scribe said that crime ratio among women is increasing day-by-day as Mafia are misusing women under the cover of Women Protection Bill 2006.
Senior advocate Qamar-uzzaman Butt said that WPA is an open violation of Article 25 of the Constitution of Pakistan, which states that there is no distinction in man and woman and both are equally treated in court according to their crime. But women were involved in serious crimes including terrorism, kidnapping for ransom, robbery, narcotics trade with the introduction of WPA. Woman murderer could get bail easily from courts, which is harmful for the social harmony in the country, he said.
He said that WPA could not provide protection to women rather anti-social mafia taking advantage by involving women in different crimes. Senior advocate Mian Abbas Ahmed former Vice Chairman of Pakistan Bar Council said that the Women Protection Act in real terms is an amendment in the Sections 496, 497 and 498 of Pakistan Penal Code, which especially deal with bail of women.
According to Article 25 of the Constitution as well as Islamic point of view, women could get relief when they are in pregnancy and secondly when they are breast feeding their children. But after pregnancy and feeding they must bear punishments according to their crimes. Lenient attitude towards criminal women is increasing crime ratio day by day in the country, he said.
He said that government should establish separate jails for women where they could meet their husbands and children but bail of women in every crime is dangerous for societies.
Mostly women misuse the act and humiliate respected persons in courts. All women could demand all rights from their husbands and fathers, they could do jobs and get education, they could get inheritance, but unfortunately dozens of women misused Women Protection Act 2006 and found involved in many serious crimes, he said.
Mirza Aziz Akhtar Baig former Vice Chairman of PBC, a specialist of criminal laws, said that Women Protection Act and Juvenile Act (Children Act) are dangerous for the society. According to these acts offences including robbery, terrorism, kidnapping for ransom etc in which the sentence is less than 10 years are made bailable for women and children.
The women involved in serious crimes including murder in which sentence is more than 10 years could be acquitted if court failed to complete trial in six months means after six months women involved in every serious crime could get acquittal, he said.
He said that men involved in narcotics, robbery, kidnapping for ransom, terrorism, national loss and murder cases could not get bail easily but under the WPA women could get the bail easily. Different non-registered private NGOs are exploiting innocent women. Hundreds of professional women are involved in prostitution openly and took great benefit of the act, he added.
Advocate Rana Naveed Akhtar suspended general secretary High Court Multan Bench said that lenient attitude for women is better but not in criminal matters. If they are found involved in crimes they should be punished like men. The WPA has created great difference between the men and women in crime matters. Respected men face great difficulties in different fake cases registered by women at different police stations. Police should investigate fake reports of women, he said.
