The Lahore High Court while dismissing a writ petition, declared abolition of cattle fee on sacrificial animals as legal. The petitioner, Tajamal Mir had challenged the abolition of cattle fee on sacrificial animals. The petitioner contended that he had got a contract of charging fee on animals' entering city that would expire in October 2009.
But the DCO Lahore, through a notification had abolished cattle fee ignoring the fact that it was categorically written in the contract that petitioner is entitled to charge Rs 20 on small animals and Rs 90 on big animals while those enter the city.
Further, the petitioner pleaded that the DCO had no authority to issue such notification therefore is liable to be declared as illegal and without any lawful authority. The Advocate General, Punjab appeared before the court said that a new notification by the relevant department was also issued in this regard. At this the judge declared the abolition of cattle fee on sacrificial animals as legal.
