The Supreme Court was asked on Wednesday for an early fixation of the case, seeking disqualification of Chairman of the Standing Committee on Education Abid Sher Ali. Maulvi Iqbal Haider filed the petition on December 5 under Article 184 of the Constitution, pleading the court to direct the National Assembly Speaker to send disqualification reference against Abid Sher Ali to the EC.
'The above-cited constitutional petition was filed by the petitioner, challenging the disqualification of Chairman of the Standing Committee on Education Abid Sher Ali. The matter could not be fixed for hearing, but it is of great public interest in respect of supremacy of the Constitution, therefore, should be fixed for hearing on December 18 or commencing week," said the application.
The application prayed that Abid Sher Ali was insisting upon the National Assembly Speaker to allow him carry on proceeding of the Standing Committee. Under these circumstances, the matter is required to be fixed for hearing as early as possible, the application added.
Earlier, Iqbal Haider, through his petition, said that the Chairman of the Standing Committee could neither discuss the conduct of Chief Justice nor ask him for resignation. Discussion over the conduct of the Chief Justice violates Article 2-A, 5,9,14,63,68,69 and 204 of the Constitution, it added.
Haider said that Chairman of the Committee Abid Sher Ali was a close relative of Nawaz Sharif, head of a political party, and was demonstrating the subject matter with political motivation in the said committee. In addition, Pakistan Muslim League (Nawaz) had started a confrontation with the judiciary and was damaging its image to weak judiciary, the petition added. Nawaz Sharif has publicly announced that he does not consider Abdul Hameed Dogar as Chief Justice of the country and will not appear before the PCO court.
Abid Sher Ali took the notice of news published in press regarding award of extra marks to the daughter of Chief Justice merely to exploit the situation as Nawaz Sharif's case was pending before the case, Maulvi Iqbal Haider contended in his petition. Federation, Chairman of the National Assembly Standing Committee on Education Abid Sher Ali, Chairman of Federal Board of Intermediate and Secondary Education and the National Assembly Speaker were made party by the petitioner.
