Pakistan Bar Council (PBC) on Monday passed a resolution to take disciplinary action against Advocate Habibul Wahab Al-Khairi on the compliant of Dr Samad Hashmi, a British psychiatrist who accused Khairi for defrauding him of 2000 pounds. The executive committee of the PBC met here Monday and passed a resolution to refer the matter against Khairi to disciplinary committee of the council.
On December 26, Dr Samad Hashmi had faxed the complaint to the disciplinary committee of the PBC. He had accused Khairi of being possibly involved in money laundering and financial fraud.
Dr Hashmi alleged that during the course of legal proceedings with his ex-wife, who happens to be the daughter of a retired but highly influential bureaucrat in Islamabad, he had received a bill from Khairi of 2,000 pounds in January 2008 through Devereux and Co Solicitors in the UK for representing his ex-wife. Khairi has failed to provide any bank transaction or any legal paperwork in respect of this payment even after several reminders, the complaint said.
Earlier, on December 23, Khairi had asked the Supreme Court to initiate a reference under Article 209 of the Constitution by constituting the SJC against the incumbent Chief Justice Abdul Hameed Dogar and two other judges of the apex court including Justice Ijaz-ul-Hassan and Justice Syed Zawwar Hussain Jaffery on the charges of 'misconduct'.
On December 26, Raja Abdul Rehman, a former Deputy Attorney General had also announced to file a contempt of court petition against Khairi for using abusive language against the judges of the apex court, in his application to the Supreme Judicial Council. The PBC passed three other resolutions as well, including legal fraternity's resolve to stand with Pakistan army in case of any aggression against the country.
Show cause notice to the office bearers of Islamabad High Court (IHC) Bar Association for taking charge of IHC bar without following norms ie process of electioneering. The last resolution passed by the executive committee of the PBC was approval of rules for employees of the PBC.
