The Islamabad High Court (IHC) on Thursday postponed the hearing of review appeal against its earlier order which legitimised award of extra marks in an intermediate examination to Farah Hameed Dogar, daughter of Chief Justice Abdul Hameed Dogar, on petitioner's plea that he was not provided with the judgement.
A single bench of Chief Justice Sardar Muhammad Aslam adjourned the hearing till March 3. Earlier, on January 16, the IHC had dismissed petitions against award of extra marks to Farah Hameed by declaring them 'without merit.' "Petitions are without merits and are thus dismissed", said Chief Justice Sardar Muhammad Aslam in a 14 page order.
A division-bench of the IHC comprising Justice Munir Paracha and Justice Saeed Akram had also dismissed an intra-court appeal filed by Azam Khan Sultanpuri of the Tehreek Falah-i-Pakistan against the decision which had declared award of extra marks Farah Hameed Dogar in her FSc examination as legal.
Iftikhar Hussain Rajput had field the review through his counsel Barrister Javed Iqbal Jaffery. The CJ directed the counsels for former chairman Federal Board of Intermediate and Secondary Education to provide judgement of a division bench over an intra court appeal regarding the main petition.
During the last hearing, the counsel for former chairman had apprised that review plea over its decision of January 16 became ineffective after a subsequent decision of a division bench.
Jaffery alleged that a fraudulent citation of laws during hearing of the main case on award of extra marks to Farah Hameed Dogar by the Federal Board of Intermediate and Secondary Education. He said in the main case he was not heard by the bench while his case was different from Muhammad Azam Khan Sultanpuri, the other petitioner. Jafferi had contended that former FBISE chairman Shamshad Ahmed's lawyers Malik Qayyum and Raja Abdur Rehman had presented wrong citations before the court.
