Chief Justice Iftikhar Muhammad Chaudhry cant dispense justice to kith and kin of missing people as he came under a deal brokered by international forces including US. Court has already issued orders for recovery of missing people and it is obligatory on the government to implement it.
This was stated by Khalid Khawaja, representative of a civil society organisation Defence of Human Rights while addressing a press conference here on Wednesday. He said that we are sure that the reinstated CJ would not be able to take up the case of missing persons. He further said that the total number of missing persons who have been registered by their families is around 600-650.
If we include those who are not reported so far the number may touch 5,000. He urged the political parties, civil society organisations and masses to start campaign just like the long march to pressurise the government to take the notice of the issue of missing persons and resolve it immediately.
He termed this issue more important than the reinstatement of Chief Justice. He further said that we have very high expectations from the Iftikhar Chaudhry. He said that CJ has to find ways and means where an ordinary citizen is assured that he will get justice without any hassle and he will not be tortured and victimised by false cases and arrogant judges.
"He must adopt measures that justice should not only be available to lucky ones who get attention by his suo motu but every victim must receive justice without much delay as he himself has been saying Justice delayed is justice denied", he added.
All the missing people must immediately be recovered and released, and their abductors must be dealt according to the law. All the victims of fake cases registered by the previous and the present government must get immediate relief and the culprits of their miseries must be dealt with according to the law.
Sharing his own personal experience he said that I have personally suffered and am currently suffering from fake cases. I filed a petition in Lahore High court in 1990 to implement section 62 and 63 of the constitution, but in spite of all my efforts I could not get the full bench which was constituted to hear the case. I also filed a writ petition in 2001 in the Supreme Court along with the victims of the cruise missiles but I have not yet been heard by the court. People must get some remedy and there should be a way to pursue the judges who deliberately delay delivery of justice.
Supreme Court gave order in 2007 on Lal Masjid and Jamia Hafsa and until now nothing has been implemented. The Chief Justice of Supreme Court ordered on 4th July 2007 that I shall not be harassed and exactly after 36 hours I was abducted and booked in a serious fake case by the same officials who humiliated the chief justice himself.
"I am also trying my level best to register an FIR against the killers of Ghazi Abdur Rashid, his mother and many others in Jamia Hafsa. After a lot of efforts the case is pending in the Supreme Court. At least the FIR of this national tragedy must be immediately registered", he added. There are thousands of victims in the jails and illegal detention centres illegally convicted by court martial and other courts and most of them are waiting for the trails of the fake cases by the previous and the present government. In the end he appreciated Mian Nawaz Sharif for his courage to fight a civilian dictator.
