The Lahore High Court (LHC) here on Friday ordered to hand over the two Austrian national children to their maternal grandparent of Austria. Secretary and vice counsel at Austrian Embassy in Islamabad Mag Alfred Bratranek had moved a habeas corpus petition on behalf of Josip Stimac and Stefica Stimac, the maternal grandparents of two children Sana Saleem Syed (13) and Abrash Syed Shah (6).
Petitioners counsel Aftab Ahmad Bajwa submitted that the childrens mother Melitta Syed Shah, wife of a Pakistan Syed Iqbal Hussain Shah, was arrested on January 11, 2008 from the Lahore airport as from her baggage 20.875 kilograms of heroin was recovered. He said the lady was an under trial prisoner at Kot Lakhpat jail and both the children were living with her behind the bars.
Counsel said Melitta wrote to Austrian Embassy at Islamabad for handing over the custody of the children to their maternal parents but later refused to hand over the children. Counsel said both the children were in jail for more than a year and were deprived of continuation of their education, freedom and humanitarian activities.
He said the children had not committed any offence. They were not required by any agency or court in Pakistan. Childrens health is also deteriorating day by day behind the bar. He requested that the directions be issued to the jail authorities to give custody of the children to the Embassy.
