The Islamabad High Court here Monday warned the Capital Development Authority official to remove the litter dumping site around sectors H-10 and G-10 immediately or to face legal consequences. The single bench of Justice Mohammad Ramzan Chaudhry in his order also expressed dissatisfaction over the report submitted by Director Sanitation, which was contrary to facts submitted by IHC Registrar on May 5.
Director General Sanitation was also directed to make special arrangements during rainy season to avoid problems for the residents. He also directed the Registrar to pay surprise visits to the site twice a month along with police officials and supervise the process.
During course of proceedings, the Judge expressed his dismay over the progress and said he could remove the concerned officials in case they failed to comply with court's orders. He expressed his anger over CDA officials' response to court's order of April 4 about complete removal of dumping site to Kurri within a period of one year.
Riaz Hanif Rahi advocate, President Citi Council Welfare, appearing in person, apprised the bench that the civic body was continuously dumping garbage in Sectors H-8 and G-10 near Kashmir Highway. The practice was causing environment hazards, as the passers by or motorists both had to endure the foul smelling of rustic garbage, he added.
He said the same bench had taken suo motu over the issue on July 2 last year and CDA had filed a compliance report on August 8 about removal of garbage. But despite all this, they continued to dump garbage in the open where nasty smell usually hovered over the whole area, he added. CDA was bound not to create environmental hazards and should be penalised under Pepa Act of 1997, he said and cited Shehla Zia's case PLD 1994 of Supreme Court. Later on hearing was adjourned till date in office.
