A division bench of the High Court of Sindh (SHC) comprising Justice Athar Saeed and Justice Safdar Ali Bhutto on Thursday adjourned a petition concerning weekly low price (Bachat Bazar) on the request of the licence holder giving him time to become an intervenor.
Earlier K. A. Wahab advocate appearing for licensee, Imran Danish submitted that he had been allowed to hold the weekly Wednesday Bazar on Saturdays and as the petition concerns low cost fair on Saturdays, he was the affected party. The bench advised him to file a proper application and adjourned further proceedings till Monday.
The petition was filed by one Shehzad Daudpota, a licensee for holding Saturday Bazar. He maintained that he was holding the Bazar at Rangers Ground since many years and suddenly his license was cancelled under Section 133 Cr. P.C declaring the activity as "causing public nuisance." The petitioner said that in the meantime the Bureau of Supply and Prices issued a license to another person for holding the Bazar on Saturday, which jeopardises the interest of the petitioner.
The petitioner maintained that he was stopped from holding the fair for mala- fide reasons and thus the impugned notice by the respondent CDGK be declared illegal and ab-initio. The SHC bench adjourned the matter directing the respective counsels including EDO Law, CDGK to argue that whether CDGK or Bureau of Supply and Prices was empowered to issue license for holding low price fairs in the city.
