Chief Justice of Lahore High Court here Wednesday released a Hindu and a Christian on bail who were arrested from Rahim Yar Khan with 300 liquor bottles. Petitioners accused Hari Chand and Atif Masih through their counsel submitted that they were non-Muslim and permit holders. They were taking liquor bottles for their personal use.
Counsel argued that the case was of further inquiry falling under sub-section 2 of section 497 Cr.Pc. The CJ asked him whether the accused were involved in any such case prior to this FIR but he failed to give satisfactory answer. Granting bail the CJ observed that no useful purpose could be served by putting the petitioners behind the bars. None of the alleged offence falls within the prohibitory clause of section 497 (1) Cr.Pc, CJ held and granted them bail.
