The Lahore High Court (LHC) here on Friday while issuing notices to Chairman Federal Board of Revenue (FBR) and Chief Commissioner Inland Revenue Services (IRS) for December 23 suspended the transfer of 488 (Grade-I to 15) employees of Income Tax and Custom department.
The court passed this order in connection with a petition filed by Khalid Zaidi and six other employees of Inland Revenue Services, a newly set up section in Income tax department. The petitioners contended that Income tax department had set up a new section named Inland Revenue Services in September and offered employees through a letter to inform it whether they are willing to go to new section.
They said it was clearly mentioned in the letter that if an employee were not willing to move to new section he would not be forced. They said that the department did not honour its commitment as 488 employees were forcibly transferred to the new section in the light of a notification issued by FBR on December 4.
They pleaded that tax department was established in 1960 through legislation and setting up a new section is illegal and un-warranted for. They prayed the court to set aside the notifications through which new section was established and employees were sent back to their previous department.
