The Lahore High Court (LHC) Chief Justice, Khawaja Muhammad Sharif here on Friday adjourned the hearing of a petition filed by four teachers against administration of Kinnaird College for Women for not allowing them to take classes as college counsel sought time to submit his reply.
On Friday, a representative of the college told the court that administration has no objection over teachers if they are willing to take classes. However, College's principal and Secretary Higher Education have not filed their replies. LHC had already ordered college administration to include names of four teachers in the list of faculty members and allow them to take classes.
Farrukh Sohail, head Islamic Studies department and others had challenged their repatriation to higher education department through a letter issued by college Principal Dr Bernadette L. Dean on December 23, 2009. The Petitioners through their counsels submitted that they have been serving as regular faculty members at KC since long.
They said Punjab higher education department on December 3, 2009 issued a letter addressed to principal KC not to transfer any regular or contract employee. But, the principal in sheer disregard to the said letter issued their transfer/repatriation orders on December 23 surrendering their services to higher education department.
Counsel pointed out that the action of the principal was also in violation of Punjab Kinnaird College for Women Ordinance 2002. They prayed to the court to declare the repatriation orders of petitioners as illegal and suspend the operation of impugned order till the final decision of the petitions.
