The Lahore High Court (LHC) here on Wednesday dismissed a petition of income tax and custom department's employees challenging their transfer to Inland Revenue Services (IRS) department after Commissioner IRS informed the court that the section was established in order to bring improvement in functioning the department.
He said that the induction of officers in the new section was being made purely in the line of rules. The seniority of the officers would not be disturbed, he added. After this statement the court dismissed the petition, however, allowed the petitioners to move federal services tribunal if they had any other grievance.
Petitioners Khalid Zaidi and six others submitted that Income tax department had set up a new section named Inland Revenue Services in September 2009 and offered employees through a letter whether they were willing to go to new section. They said it was clearly mentioned in the letter that if an employee were not willing to move to new section he would not be disturbed.
They said that the department did not honour its commitment and 488 employees were transferred forcibly to the new section on December 4, last year. They pleaded that tax department was established in 1960 through legislation, and setting up a new section is illegal and un-warranted. Petitioners prayed to the court to set aside notification under which new section was established.
