The Supreme Court on Thursday termed the report submitted by the Ministry of Defence on the status of missing person as unsatisfactory and vague, giving the government two-week time for tracing their whereabouts. Headed by Justice Javed Iqbal, an apex court bench hearing the case of missing persons also hinted at deciding the matter next month (February).
Earlier, Deputy Attorney General Shah Khawar submitted a report on behalf of Secretary Defence and Secretary Interior regarding Masood Janjua, who is missing since 2004. The report stated missing Janjua was neither in the custody of Military Intelligence (MI) nor Inter Service Intelligence (IS1).
A three-member bench comprising Justice Javed Iqbal, Justice Raja Fayyaz Ahmed and Justice Sair Ali heard the petitions of the Human Rights Commission of Pakistan and former PPP Senator Farhatullah Babar. The court gave a deadline of two weeks to Deputy Attorney General Shah Khawar for recovery of Masood Janjua and Attiqur Rehman, a medical student who was allegedly picked up by the secret agencies on his wedding day from Abbotabad in 2004.
The court observed that the evidence provided by Amina Masood Janjua about her spouse Masood Janjua to Ministry of Interior was not examined. "The Secretary Interior should avoid the role of post office and concentrate seriously on the issue by implementing the court's order," the bench observed.
Justice Javed Iqbal said that more than 198 missing persons have been traced since the court took up the missing persons' case. The court will not ridicule any institution and everything will be done according to the constitution, he added.
SP Potohar Town apprised the Court, after addressing a letter to the Ministry of Interior, a joint investigation has been started on the FIR of Masood Janjua requesting the court for two weeks time to complete the probe.
The court also directed the government to expedite the process of furnishing details of Pakistanis handed over to US during Musharraf's reign besides asking for complete details of Pakistani prisoners languishing in foreign jails. Deputy Attorney General Shah Khawar informed the court that they have intimated the foreign mission after categorising the list of the people.
