The incidents of high-handedness by police against common citizens are increasing and the Supreme Court could not close its eyes to the same, observed Chief Justice Iftikhar Muhammad Chaudhry on Tuesday. The bench was hearing a review petition filed by two police officials against a judgement of the High Court of Sindh wherein they were ordered to not be given field posting for two years after they were held guilty of lodging a false FIR against a farmer Ghulam Muhammad Talpur.
The petitioners Ata Muhammad and Dur Muhammad booked the aged man on the grounds that he occupied and encroached upon three acres of land owned by Najamuddin Talpur. Former Justice Muhammad Sadiq Leghari representing the petitioner submitted that petitioners have no role in lodging of FIR.
He sought review of the orders of SHC on purely legal grounds. Ghulam Muhammad Talpur who was also present in the court on query by the Court narrated his ordeal that how he was humiliated by SHO Dur Muhammad and of his alleged illegal arrest and detention once he was released from prison on bail.
The bench expressed extreme displeasure and to pleading of the counsel for petitioners / appellants said that if legal procedure is followed, the old man would die waiting for justice. The bench also viewed the inquiry report conducted by DIG Mirpurkhas and recommendations made therein. The bench also inquired from the Deputy Prosecutor General Sindh who said that the bench has rightly termed it as a case of extreme high-handedness by police officers concerned.
"The police officials are supposed to act as per law and within the boundaries of law. I know how they (police officers) behave. We are noticing the increasing instances of police high-handedness not only in Sindh but others parts of the country. The Supreme Court could not simply shut it eyes," observed Chief Justice Iftikhar Muhammad Chaudhry.
The bench after detailed hearing, disposed of the review petition with order to the concerned Sessions Court to expeditiously dispose of the hearing of alleged foisted case against Ghulam Muhammad Talpur in two months, direction to DIG to make an inquiry and fix responsibility that which police officer is involved in high-handedness against Ghulam Muhammad Talpur and to take departmental action as per police rules.
