The Supreme Court on Thursday referred Advocate Hanif A Rahi's case to Punjab Bar Council for initiating disciplinary action for his attempt to scandalise judges of the apex Court. The petitioner had challenged position of both Chief Justice and Justice Khalil ur Rehman Ramday, as judges.
"We have gone through the plea, which is nothing but scandalous,"...observed a six-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Chaudhry Ijaz Ahmed, Justice Khilji Arif Hussain, Justice Rehmat Hussain Jafferi, Justice Tariq Pervez and Justice Khalil ur Rehman Ramday. The court also dismissed plea of Hanif A Rahi seeking formation of a new bench excluding the CJ, Justice Ghulam Rabbani and Justice Ramday.
At the outset of hearing, Rahi said he would not argue merits of his three cases as he had submitted an application against the sitting Chief Justice and two other ad hoc judges, therefore a separate bench should be constituted.
"I do not regard two of you, as judges. Let me allow to argue and if prove me wrong, cancel my license and send me to jail," he added. Justice Ramday observed that a court could not function without a Chief Justice and if you considered it unconstitutional then had he appeared before it. Hanif Rahi appeared in appeals against his conviction in contempt of court by an additional session judge and high court judge.
