The Supreme Court on Friday called for an explanation from Malik Tabarik Hussain alias Malik Bari regarding his uninformed visit outside the country despite being on bail. Karachi police arrested Bari from Islamabad last year on the charges of a fake case without fulfilling legal requirements.
However, on October 27, 2009, the court had ordered his release against a surety bond of Rs 0.5 million. The court also called for record of all cases against Bari registered in Karachi and observed that he had exploited the apex court to force his rival for a deal.
Malik Bari had blamed Malik Riaz, chief executive Bahria Town for the entire episode. Bari had contended that Riaz took revenge from him for advocating for hundreds of those people who claim that Malik Riaz had grabbed their lands.
The issue came to the fore when the court took a suo motu notice on the appeals of Raja Riasat which appeared in the print media, requesting the Chief Justice to take action against Dr Shafeequr Rehman of Allied Developers for committing murder of his son Fiaz, security guard Defence Housing Society.
In addition to the allegations of Malik Bari, widow of the deceased (Fiaz) had also accused Malik Riaz for the murder of her husband. Advocate Sardar Asmat Ullah, counsel for Malik Bari and Tahir Alam, SSP Islamabad appeared before the court, whereas Bari was absent.
To a court's query regarding the whereabouts of Malik Bari, Sardar Asmat informed the bench that his client was out of the country for medical treatment. On the reply of counsel, the court remarked that Malik Bari had undermined the court, which had ordered his bail.
A three-member bench of the apex court comprising Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry, Justice Chaudhry Ijaz Ahmed and Justice Khalilur Rehman Ramday, directed Senior Superintendent of Police (SSP) Islamabad to arrest Bari the moment he enters country and send him to Karachi where cases were registered against him.
The CJP inquired about the matter regarding murder of a security guard, which Bari had alleged, was done on the directions of Malik Riaz. Deputy Attorney General Agha Tariq informed the court that concerned parties had reached an agreement and all cases in that respect were quashed. Tahir Alam revealed that the deal involved billions of rupees and Malik Bari had got Rs 1 billion.
The CJP observed that Bari exploited the court to benefit from his rival and the court would send him to Karachi and direct revival of all cases against him. However, Sardar Asmat Ullah counsel for Malik Bari requested the court not to cancel his client's bail saying he would soon appear before the court. The court accepted the request and issued notice to Malik Bari to appear before the court and explain his action on April 20.
