The Lahore High Court (LHC) here on Friday dismissed a petition seeking reopening of fresh trial of former Prime Minister Zulfqar Ali Bhutto observing that the petitioner has no locus standi in the matter. The court while dismissing the petition observed that the petitioner was neither legal heir nor aggrieved person from the trial, therefore, he could not file the petition.
Advocate Rana Ilam-ud-Din moved the petition requesting for fresh trial of Bhutto. He stated that Bhutto was not tried and sentenced by a trial court, he was tried by the LHC, which is a constitutional court, and it could not try a murder accused. The petitioner also raised a number of questions in his petition and submitted that the court should take up these questions and pass a verdict.
He submitted that the court had to decide whether a constitutional court could hear a criminal case, whether the government had authority to transfer a criminal case to a constitutional court, whether a court could hear a case if the court lose confidence in the eyes of accused, whether a court could take away the right of appeal from an accused and whether an accused could be awarded capital punishment on the statement of an approver or accomplice? He therefore prayed the court to call the record of the case and make decision again according to facts and circumstances of the case.
