Lahore High Court on Thursday while allowing time to an additional advocate general to apprise the court about the proposed schedule of local bodies election in Punjab, adjourned the proceedings to July 19 in a petition challenging the appointment of administrators.
Earlier, the additional advocate general Ahmad Rauf informed the court that meetings of the election authorities were being held to decide the fate of local bodies election, however, no final date had been decided so far. The court was hearing a petition of Local Councils Association Pakistan (LCAP) challenging appointments of administrators in Punjab after making amendment to Punjab Local Government Ordinance 2001.
The court however directed the law officer to come up with a proposed schedule of the local bodies' elections in the province. On last hearing, the court had directed the federal and provincial governments to inform about schedule of local bodies' elections.
LCAP director Anwar Hussain had filed the petition through counsel Fawad Hussain Chaudhry. He argued that by adopting the same sequence, provincial government on the basis of its numerical strength in the provincial assembly enacted Punjab Local Government (Amendment) Act 2010 in clear violation of Article 140-A, 2-A, 7, 9, 17, and 32 of the Constitution.
The provincial government not only dissolved local bodies but also appointed administrators in February 2010 in total negation of the limits subscribed by the Constitution. He therefore prayed to the court to declare unconstitutional the impugned amendment and appointments of administrators.
