The Lahore High Court (LHC) here Friday disposed of a petition seeking registration of fraud case against a former MNA of PPP from NA-184, Bahawalpur, Amir Yar Waran, who had resigned owing to fake degree. The petition was filed by Muhammad Arshad Pirzada, a voter of the constituency, saying Supreme Court had declared degree of the MNA bogus, however, he resigned from the office before announcement of apex court's decision.
Petitioner's counsel Aftab Ahmad Bajwa stated that by tendering resignation criminal act of the MNA was not undone so a case of fraud should be registered against him.
He sought court's directions for registration of a case against the resigned MNA in the light of observations made by apex court. The LHC, however, asked the petitioner to approach election commission for the redressal of his grievance and disposed of the petition.
According to details, Amir Yar had acquired his B.Com degree from Shah Abdul University Khairpur, Sindh in year 1997. But the university on verification request of one Muhammad Rafique Qamar had termed the degree possessed by Yar as bogus. Petitioner had said that LHC Bahawalpur bench following the report of the university had declared him ineligible to contest election.
He said the respondent later appeared in examinations of B.A from Islamia University Bahawalpur and found guilty of impersonation. A disciplinary committee of the university had disqualified him for a period of three years as well as cancelled his examination of B.A.
He said the respondent despite ban of three years imposed on him he got registration in Balochistan University and appeared in exams of B.A in year 2004. But he could not pass the examination. The Balochistan University also initiated proceedings against the respondents and held him guilty of concealing facts and keeping bogus degree.
