Capital Development Authority (CDA) has awarded a toll tax collection contract at Golra Sharif on main Kashmir highway without public tendering in violation of Public Procurement Rules 2004, to M/s Bright Business, according to a complaint received by Transparency International Pakistan.
Chairman, TI Pakistan, Syed Adil Gilani has in a letter sent to the Chairman, CDA, Imtiaz Inayat Elahi requested him to confirm the authenticity of the allegation, whether it is true or false. PPR - 2004 have eliminated all discretions in procurement process and avenues of corrupt practices in tendering. In the case the report is found correct, the procurement may be declared as mis-procurement under Rule: 50 and the procurement may be dealt under Rule 2 (f), ie corruption and fraudulent practice, which reads as under:
"Rule 2 (f): corrupt and fraudulent practices include offering, giving, receiving or soliciting of anything of value to influence the action of a public official or the supplier or contractor in the procurement process or in contract execution to the detriment of procuring agencies; or misrepresentation of facts in order to influence a procurement process or the execution of a contract, collusive practices among bidders (prior to or after bid submission) designed to establish bid prices at artificial, non-competitive levels and to deprive the procuring agencies of the benefits of free and open competition and any request for, or solicitation of anything of value by any public official in the course of the exercise of this duty." Copies of the letter have been sent to: Chairman, PAC, Auditor General of Pakistan, Registrar, Supreme Court of Pakistan, and Managing Director, Public Procurement Regulatory Authority.
