A division bench of the Lahore High Court (LHC) has set aside death sentence of a convict and life imprisonment of two convicts and ordered to acquit them after giving them benefit of doubt. The bench observed that "We are of the considered view that prosecution has miserably been failed to prove its case against the appellants."
It held: "In our view the prosecution case is full of doubts and the appellants are entitled to the benefit of the same not as a matter of grace but as a matter of right. The bench issued this order while allowing the appeal of three accused of killing a man. The trial court of Faisalabad on March 29, 2005 awarded death sentence to accused Muhammad Ishfaq and a fine of Rs 100,000 and awarded life imprisonment to accused Abdul Rehman and Abdul Rasheed. They were also directed to pay Rs 50000 each as compensation to legal hairs of the deceased.
