An advocate Rana Ilam-ud-Din here Thursday moved an appeal before Supreme Court of Pakistan challenging the Lahore High Court order of dismissing his petition requesting for fresh trial of former Prime Minister Zulfiqar Ali Bhutto. He moved this petition before Lahore registry of the Supreme Court.
Justice Ijaz Ahmed Chaudhry now Chief Justice of Lahore High Court on April 16 had rejected the constitutional petition of Rana Illam by holding that petitioner lawyer is not an aggrieved person. He stated that even Bhutto was not tried and sentenced by a trial court, he tried by the Lahore High Court, which is a constitutional court, and it could not try a murder accused. He challenged the single bench order through an inter court appeal but it also met the same fate and now he moved appeal before apex court.
Applicant said that the retrial was necessary as the conviction of Bhutto was a controversial decision and had far reaching effect on the country. He had requested that court should call the record of the case and a fresh decision according to facts and circumstances of the case, a fresh decision should be announced to wash the allegation, which were levelled against the judiciary.
