A full bench of the Lahore High Court (LHC) here on Friday turned down a request of Deputy Attorney General (DAG) to adjourn for an indefinite period a petition against presidential pardon to interior minister Rehman Malik and fixed January 24 for final arguments.
The DAG Naveed Inayat Malik had requested the bench appeals against conviction by interior minister were pending adjudication before Supreme Court, therefore, the bench should not continue proceedings on the petition. The bench, however, observed that the matter before the apex court was different in nature and proceedings before high court would not have any affect on matter.
The bench directed the DAG and the petitioner counsel to come up on next hearing with final arguments on the point whether the President of Pakistan rightly exercised his power while granting remission to Rehman Malik. The petition was filed by Imtiaz Rashid Qureshi, media advisor of Save Judiciary Committee (SJC), who contended that the remission had been made in violation of the set procedure for such a pardon or remission under the constitution. The petitioner prayed to the court to restore the sentence of Rehman setting aside the notification of presidential pardon and restore conviction of Rehman Malik.
