The Lahore High Court here Wednesday adjourned to January 21 the hearing of a constitutional petition questioning eligibility of Sardar Latif Khosa for appointment as Governor Punjab due to serious corruption charges on record against him as counsel from both the side could not appear before the court due to their engagements.
On previous date of hearing the court judge had admitted the petition for regular hearing and summoned Mian Abdul Qadus President Lahore High Court Bar Association, and Deputy Attorney General and Additional Advocate General Punjab for assistance in further proceedings.
Petitioner Muhammad Nawaz Cheema advocate submitted that Latif Khosa was removed from the office of Attorney General because of corruption charges and hence under article 62 and 63 of the constitution, Khosa is not eligible to be appointed as governor. The petitioner asked the court to declare his appointment as unconstitutional and illegal.
He contended that the recommendation and advice for the said appointment was illegal as the Lahore High court had held Latif Khosa as a man of professional misconduct in two cases and had directed subordinate judiciary throughout province not to take notice of any order or document referred to by respondent unless a certified copy of such order was produced.
The petitioner contended that, " Respondent is not qualified to be elected as member of National Assembly as per Article 62 and 63, hence he is not eligible person for the appointment as governor". He pleaded that the respondent was removed from office of attorney general on corruption charges on the direction of Supreme Court in a case.
