Sindh High Court Friday issued a show cause notice to Deputy Attorney General, as under what authority lifer Ahmed Omer Sheikh, convicted in US journalist Daniel Pearl's murder case, was shifted from Karachi to Sukkur prison without seeking court's permission.
A division bench, comprising Chief Justice Mushir Alam and Justice Syed Hasan Azhar Rizvi, also ordered office to fix appeal of appellant/convict Ahmed Omer Sheikh pending since 2002, in first week of April 2011. Ms Zeenat, mother of appellant/convict Ahmed Omer Sheikh, moved miscellaneous applications submitting that her son was transferred from prison of Karachi to Sukkur. She submitted that she was a 70-year-old and her source of income was very meager, therefore, could not afford to even visit her son in Sukkur frequently.
Applicant submitted she was at last stage of life and wanted to see her son and prayed to order prison authorities to shift Omer back to Karachi's prison from Sukkur. On Friday, Muhammad Aslam, brother of appellant/convict Omer Sheikh, submitted prison authorities shifted Omer out of Karachi without obtaining order from court. He stated appeal of Sheikh, challenging his conviction and life imprisonment awarded in Daniel Pearl murder case, was pending since filed in 2002.
The court ordered,"Notice be issued to DAG to show cause as to why appellant was shifted from Karachi to Sukkur without permission of the Court, if so, under whose authority. It is complained that matter is pending since 2002. Let the case be fixed at 11:00AM in first week of April 2011."
