The Lahore High Court on Tuesday issued notice for May 18 to federation and Attorney General of Pakistan (AGP)on a petition filed by former President Muhammad Rafiq Tarar for directions to remove all references made to Pervez Musharraf in public and official records showing him as president.
Justice Sh Azmat Saeed was hearing the petition by the former President through counsel Abid Hasan Minto wherein it was submitted that he took oath of the president's office on January 1,1998 and at that time, salary payable to the president was Rs 23,000 and entitled for pension of Rs 10,000.
The petitioner counsel contended that he legally continued as president till September 8, 2008, when Asif Ali zardari assumed the office of president. Minto submitted unfortunately this principle of keeping salary and pension of the president higher than other state functionaries could not be carried out.
He prayed the court to declare that the petitioner never resigned from the office and continued as president till oath of Asif Ali Zardari as president. He prayed the court to declare that the petitioner was entitled to receive pension from September 9,2008 at the rate of 85 percent of the salary as determined under prayer.
