Contempt notice sought against irrigation department: Marvi moves Supreme Court
Former Member National Assembly, Marvi Memon on Wednesday filed a petition in the Supreme Court, seeking contempt of court notice against irrigation department for not implementing the Flood Commission's recommendations. The petition was filed under Article 187, 190 and 204 of the Constitution making Secretary, Sindh Irrigation Department and Secretary, Punjab Irrigation Department as respondents.
She pleaded that the court direct the government to implement the Flood Commission report in letter and spirit. The Flood Commission may be directed to investigate the dykes technically and thoroughly so that the strengthening of these dykes may be expedited before next floods.
In her petition Marvi said it is a settled law now that Article 190 of the Constitution is a mandatory provision. "The Executive is duty bound to act in aid of the SC and implement the judgement of the apex court in letter and spirit without any delay." The non-implementation or delay in the implementation of the judgement of the SC is contempt of court in terms of Article 204 of the Constitution and the contemnors have made themselves liable to be punished accordingly," she added.
The petitioner contended that the contumacious acts of contempt of the orders of the apex court also amount to an unprovoked and naked attack on the independence of judiciary and the rule of law. The petitioner also sought directions in terms of Article 187, 190 and 204 of the Constitution.
