The Lahore High Court here Monday suspended an order which reverted to a deputy secretary of Evacuee Trust Property Board (ETPB) to step down as assistant date control officer. The court also sought reply from ETPB chairman and other respondents within one month.
The petitioner Ghulam Sarwar, deputy secretary/ administrator through his counsel Arshad Nazir Mirza submitted that his case for promotion was pending before departmental promotion committee and the ETPB authorities through a notification reverted to him two-step down.
Counsel said the impugned notification was patently illegal, void, a result of mala fide and without jurisdiction. He said the petitioner was condemned unheard as no opportunity of hearing had been provided to the petitioner prior to the passing of the impugned order. Petitioner, therefore, prayed to declare the impugned order illegal, void, result of malice and extraneous considerations and of no legal effect.
